A
Court of Appeal sitting in Kaduna has upheld the appeal of the
governorship candidate of the Peoples Democratic Party, PDP, Abba Yusuf,
challenging a Federal High Court’s order that sacked him as the party’s
candidate.
Delivering the judgement on Thursday, Justice Tanko
Hussaini of the Court of Appeal, Kaduna said the Federal High Court
judge erred in law by assuming jurisdiction without the plaintiff,
Ibrahim Little, joining the necessary party, Abba Yusuf.
The judge also said Mr Little lacked locus standi to institute action challenging the process that he did not participate in.
On
March 4, a Federal High Court sitting in Kano sacked the governorship
candidate of the People’s Democratic Party, PDP, Abba Yusuf, in the
state.
The presiding judge of the Court 1, Lewis Allagoa, ruled
that the PDP did not conduct governorship primary election in the state.
Mr
Little, had approached the court, challenging the process that led to
the emergence of Mr Yusuf as PDP gubernatorial candidate in Kano, saying
Mr Yusuf emerged as a candidate through unlawful process
