2019 polls: Enugu Court dismisses suit against Chimaroke Nnamani’s candidature

A Federal High Court sitting in Enugu, Thursday, dismissed a suit seeking to disqualify Senator Dr. Chimaroke Nnanami from standing as the Peoples Democratic Party, PDP, Senatorial candidate in Enugu State.

Former Governor Nnamani is the candidate of the PDP for Enugu East senatorial zone.
we reports that one Chukwunonso Daniel Ogbe had approached the court seeking Nnamani’s disqualification over the affidavit he submitted to the Independent National Electoral Commission, INEC, for the election.

But Senator Nnamani’s counsel, Dr. Onyechi Ikpeazu, SAN, had filed a preliminary objection before the court, arguing that the case was statue bared and that the plaintiff lacked the locu standi to institute the matter.
Delivering judgement, Justice Buba Mohammed of the FHC Enugu dismissed the suit for lacking in merit.
In an elaborate judgement, Justice Buba held that the plaintiff’s case had no foundation, lacked in substance and was misconceived.

The court further agreed with the defendant that the suit was statue barred as it was not initiated withing the time frame allowed by the law.
It went ahead to award a cost of N250,000 in favour of the first and second defendants.
